Pine Lodge Nursing and Rehabilitation Center. Pine Lodge Nursing and Rehabilitation Center sent a letter addressed to the union representing its employees offering a wage increase. Shortly after sending the letter Pine Lodge posted a copy of it near the employee time clock so employees could read it. The union allowed the offer to expire and Pine Lodge sent another offer to the union. Pine Lodge copied this offer to its employees after sending it to the union. The union charged Pine Lodge had violated the NLRA by dealing directly with its employees thus refusing to bargain collectively with the representatives of the employees. Was the publication of the letters to the employees after sending them to the union a refusal to bargain with the union?
